These Terms of Service ("Terms") govern your access to and use of the Myndora Care website and health monitoring platform operated by Myndora Solutions. Please read them carefully. Our Privacy Policy explains how we handle your personal information.

1. Agreement to Terms

By accessing or using the Myndora Care website, waitlist, or platform (collectively, the "Services"), you agree to be bound by these Terms. If you do not agree, you must not use the Services. If you register on behalf of a patient or family member, you represent that you have the authority to do so.

2. About Myndora Care

Myndora Care is a community health worker (CHW)-powered home health monitoring and care coordination platform. It helps families monitor loved ones through verified remote checks, physical home visits, vitals reporting, abnormal-reading alerts, and family dashboard visibility. Myndora Care is provided by Myndora Solutions, based in Ilorin, Kwara State, Nigeria.

3. Eligibility

You must be at least 18 years old to create an account or join the waitlist as a sponsor or provider. If you register care for a minor or a patient who lacks capacity to consent, you must be an authorized caregiver, legal guardian, or family sponsor acting within the scope of your authority and applicable law.

You agree to provide accurate, current, and complete information when using the Services.

4. Service Description

Depending on your subscription or package, the Services may include:

  • A family sponsor dashboard with vitals history, visit status, notes, and alerts
  • CHW-led remote health check-ins and physical home visits
  • Visit proof (GPS, timestamps, confirmations) and service notifications
  • Abnormal-reading escalation and follow-up coordination
  • Clinician review for flagged cases where licensed and authorized

Specific features, visit frequency, and pricing depend on the plan or package you select. Early-access and pilot offerings may differ from full launch services.

5. Medical and Service Boundaries

Myndora Care is a health monitoring and care coordination platform. It is not a hospital, emergency dispatch service, ambulance provider, or diagnostic telemedicine service unless a licensed clinician is explicitly involved in a supported review pathway.

Community health workers using the platform may not diagnose medical conditions, prescribe medications, alter treatments, or represent themselves as physicians unless they hold that qualification and operate within an authorized scope.

Health vitals and alerts are for monitoring and coordination — not a substitute for professional medical advice, emergency care, or in-person clinical evaluation. If you believe someone is experiencing a medical emergency, contact local emergency services immediately.

6. User Responsibilities

You agree to:

  • Obtain valid patient or caregiver consent before health data is shared with family sponsors
  • Provide accurate patient information, contact details, and emergency contacts
  • Use the Services only for lawful purposes and in accordance with these Terms
  • Not misuse, reverse-engineer, or interfere with the platform or other users' data
  • Seek appropriate emergency or clinical care outside the platform when urgently needed

7. Subscriptions and Payments

During early access and pilot phases, pricing, packages, and payment methods will be communicated before you are charged. Subscription fees, remote check fees, physical visit fees, and clinician review fees may be billed separately depending on your selected plan.

Prices are subject to change with reasonable notice before renewal or new purchases. Where possible, payments should be made on-platform to reduce fraud and ensure service accountability.

Refund and credit policies for failed, disputed, or missed services will be published before general availability and may vary by package.

8. CHW and Provider Conduct

Community health workers and other providers must complete identity verification, credential checks, references, training, and admin approval before serving patients. Providers agree to:

  • Complete assigned checks and visits honestly and within scope
  • Not fabricate readings, visits, or proof of service
  • Escalate abnormal readings or concerning symptoms promptly
  • Respect patient dignity, privacy, and local-language needs

9. Disputes and Service Quality

Family sponsors and patients may raise disputes regarding service completion, quality, or accuracy of records. Myndora Solutions will review disputes in good faith and coordinate resolution where possible.

Myndora Care facilitates care coordination and visibility but does not guarantee specific health outcomes. Our role is to support verified service delivery, notifications, and escalation — not to replace licensed clinical judgment or emergency services.

10. Intellectual Property

The Myndora Care name, logo, website content, platform design, and related materials are owned by Myndora Solutions or its licensors. You may not copy, modify, distribute, or create derivative works without our prior written consent, except as permitted by law.

11. Limitation of Liability

The Services are provided on an "as is" and "as available" basis to the fullest extent permitted by law. Myndora Solutions does not warrant uninterrupted, error-free, or completely secure operation.

To the maximum extent permitted by applicable law, Myndora Solutions and its officers, employees, contractors, and partners shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill arising from your use of the Services.

Nothing in these Terms excludes liability that cannot be excluded under Nigerian law, including liability for fraud or willful misconduct.

12. Termination

We may suspend or terminate your access to the Services if you violate these Terms, misuse the platform, or pose a risk to patients, providers, or platform integrity. You may stop using the Services at any time.

Provisions that by their nature should survive termination — including medical disclaimers, limitation of liability, and governing law — will remain in effect.

13. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Nigeria, unless otherwise required by mandatory applicable law.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, provide notice through the platform, email, or other reasonable means. Continued use after changes take effect constitutes acceptance of the updated Terms.
